GKW TRAILER RENTALS OF NWFL

TRACTOR RENTAL AGREEMENT

This Tractor Rental Agreement ("Agreement") is a legally binding contract between GKW Trailer Rentals of NWFL ("Lessor") and the signing Customer ("Lessee"). By signing electronically or physically, Lessee agrees to all terms and conditions stated below.

1. PARTIES

Lessee: The individual whose name and signature appear on the rental invoice or electronic checkout confirmation.

2. EQUIPMENT

This Agreement applies to the tractor and any attachments rented under the corresponding invoice, including but not limited to loaders, box blades, rotary cutters (bush hogs), grapples, forks, or other implements provided by GKW Trailer Rentals of NWFL.

All equipment provided is collectively referred to as the “Equipment.”

3. RENTAL TERM

The rental period begins at the time of pickup or delivery and ends upon return and inspection of the Equipment by GKW Trailer Rentals of NWFL.

Late returns are subject to additional daily rental charges at the standard posted rate.

4. PAYMENT TERMS

Lessee agrees to pay all rental charges, deposits, delivery fees, taxes, and applicable service charges associated with the rental.

By signing this Agreement, Lessee authorizes GKW Trailer Rentals of NWFL to charge the payment method on file for:

  • Rental charges

  • Security deposits

  • Damage or repair costs

  • Cleaning fees

  • Refueling charges

  • Late return fees

  • Loss of use or downtime

  • Collection costs if applicable

5. CONDITION OF EQUIPMENT

Lessee acknowledges that the Equipment is received in good working condition unless otherwise documented prior to release.

Lessee is responsible for inspecting the Equipment before use and must immediately report any issues.

Lessee agrees to perform basic operational checks during the rental period, including monitoring fluid levels, tire condition, and visible safety concerns.

6. OPERATOR REQUIREMENTS

The Equipment may only be operated by individuals who:

  • Are at least 18 years of age

  • Are competent and experienced in tractor operation

  • Are not under the influence of drugs or alcohol

Subleasing, lending, or allowing unauthorized operators is strictly prohibited.

7. PROHIBITED USE

The following uses are strictly prohibited:

  • Underground utility work without proper marking

  • Overloading beyond manufacturer specifications

  • Towing beyond rated capacity

  • Reckless, abusive, or negligent operation

  • Alteration or modification of Equipment

8. DAMAGE, LOSS, TIRE & IMPLEMENT DAMAGE

Lessee assumes full responsibility for all damage, loss, theft, or destruction of the Equipment from the time it leaves GKW Trailer Rentals of NWFL’s possession until it is returned and inspected.

Tire & Implement Damage: Lessee is responsible for any damage to tires, wheels, and rented implements, including punctures, cuts, or blowouts. Normal wear-and-tear is not considered damage. Lessee agrees to pay full repair or replacement costs for damaged tires or implements resulting from use, misuse, or negligence.

Lessee agrees to pay:

  • Full repair or replacement cost for all damages

  • Loss of rental income during downtime

  • Recovery and transportation expenses

Responsibility applies regardless of fault.

9. TRANSPORTATION & SECURING EQUIPMENT

Lessee is solely responsible for:

  • Properly securing the Equipment and all attachments during transport.

  • Using appropriate trailers, tie-downs, chains, straps, or other approved securing methods.

  • Ensuring the trailer, vehicle, and load comply with all local, state, and federal safety laws.

  • Preventing the Equipment from shifting, falling, or causing damage to property or people.

Lessee agrees that GKW Trailer Rentals of NWFL shall NOT be liable for any damage, injury, or fines arising from transport, improper loading, or unsecured equipment.

10. ASSUMPTION OF RISK, WAIVER OF LIABILITY & INDEMNIFICATION

Lessee understands that operation of tractors and related implements involves inherent risks, including but not limited to rollover, equipment malfunction, flying debris, uneven terrain hazards, property damage, serious bodily injury, or death.

Lessee voluntarily assumes all risks associated with the possession, transport, and operation of the Equipment, whether caused by use, misuse, negligence, or otherwise.

Lessee agrees that GKW Trailer Rentals of NWFL shall NOT be responsible or liable for any bodily injury, death, or property damage arising from the use or misuse of the Equipment, regardless of fault, except where prohibited by law.

Lessee agrees to indemnify, defend, and hold harmless GKW Trailer Rentals of NWFL from any and all claims, injuries, damages, lawsuits, losses, costs, or liabilities arising from possession, transport, or operation of the Equipment.

GKW Trailer Rentals of NWFL shall not be liable for indirect, incidental, or consequential damages resulting from Equipment use or malfunction.

11. FUEL & CLEANING

Equipment must be returned clean and fueled to the same level as provided. Additional charges may apply if Equipment is returned excessively dirty or low on fuel.

GKW Trailer Rentals of NWFL will provide empty fuel containers (fuel jugs) during the rental period for the sole purpose of refueling the rented tractor. Lessee is responsible for safely transporting, filling, and handling fuel. GKW Trailer Rentals of NWFL is not responsible for spills, contamination, improper fuel use, or injuries resulting from fuel handling or refueling activities.

12. DEFAULT

Failure to comply with this Agreement authorizes GKW Trailer Rentals of NWFL to terminate the rental immediately and recover the Equipment at Lessee’s expense.

13. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Florida.

14. ENTIRE AGREEMENT

This Agreement represents the entire understanding between the parties. No oral statements or prior agreements shall modify these terms.
